{"id":39,"date":"2026-06-03T16:47:32","date_gmt":"2026-06-03T21:47:32","guid":{"rendered":"https:\/\/hosting64289us-cp7037.wordpresstemporal.com\/selva\/legal\/privacidad\/"},"modified":"2026-06-19T18:13:21","modified_gmt":"2026-06-19T23:13:21","slug":"privacidad","status":"publish","type":"page","link":"https:\/\/selvaib.com\/en\/legal\/privacidad\/","title":{"rendered":"Privacy Policy"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Selva Investment Banking, a company identified with Tax ID 901.875.289, domiciled in Bogot\u00e1 D.C., Colombia (hereinafter \"Selva IB\", the \"Company\" or the \"Controller\"), in compliance with Statutory Law 1581 of 2012, Decree 1377 of 2013 (compiled in Single Regulatory Decree 1074 of 2015) and other concordant rules, adopts this Personal Data Processing and Protection Policy.<\/p>\n\n\n<h2 class=\"wp-block-heading\">1. Legal framework<\/h2>\n\n\n<p class=\"wp-block-paragraph\">This policy is based on articles 15 and 20 of the Political Constitution, on Law 1581 of 2012, on Single Regulatory Decree 1074 of 2015 and on the instructions of the Superintendence of Industry and Commerce (SIC) as the National Data Protection Authority.<\/p>\n\n\n<h2 class=\"wp-block-heading\">2. Definitions<\/h2>\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Authorisation:<\/strong> the Data Subject's prior, express and informed consent to the Processing of their data.<\/li>\n\n\n<li><strong>Database:<\/strong> an organised set of personal data subject to Processing.<\/li>\n\n\n<li><strong>Personal data:<\/strong> information linked to or associable with one or more specified or identifiable natural persons.<\/li>\n\n\n<li><strong>Sensitive data:<\/strong> data affecting the Data Subject's privacy or whose misuse may give rise to discrimination (health, biometric data, racial origin, beliefs, among others).<\/li>\n\n\n<li><strong>Processor:<\/strong> the person who carries out the Processing on behalf of the Controller.<\/li>\n\n\n<li><strong>Controller:<\/strong> the person who decides on the database and\/or the Processing; in this case, Selva IB.<\/li>\n\n\n<li><strong>Data Subject:<\/strong> the natural person whose data is subject to Processing.<\/li>\n\n\n<li><strong>Processing:<\/strong> any operation on personal data: collection, storage, use, circulation or deletion.<\/li>\n\n<\/ul>\n\n\n<h2 class=\"wp-block-heading\">3. Principles<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Selva IB will apply the principles of legality, purpose, freedom, accuracy or quality, transparency, restricted access and circulation, security and confidentiality, in accordance with article 4 of Law 1581 of 2012.<\/p>\n\n\n<h2 class=\"wp-block-heading\">4. Purposes of the Processing<\/h2>\n\n\n<ul class=\"wp-block-list\">\n<li>To respond to contact, information and advisory requests made through the website or other channels.<\/li>\n\n\n<li>To manage the contractual and commercial relationship with clients, prospects, suppliers and partners.<\/li>\n\n\n<li>To provide the contracted investment banking and financial advisory services.<\/li>\n\n\n<li>To comply with legal and regulatory obligations, including due diligence and know-your-customer processes.<\/li>\n\n\n<li>To carry out administrative, accounting, tax and invoicing tasks.<\/li>\n\n\n<li>To send institutional, commercial and marketing communications, where the Data Subject has authorised this.<\/li>\n\n\n<li>To carry out statistical analysis and improvement of the services and the website.<\/li>\n\n<\/ul>\n\n\n<h2 class=\"wp-block-heading\">5. Sensitive data and data of minors<\/h2>\n\n\n<p class=\"wp-block-paragraph\">The Data Subject is not obliged to authorise the Processing of sensitive data. Where required, Selva IB will request explicit authorisation and inform the purpose. The Processing of data of children and adolescents will only be carried out in their best interest and through their legal representative.<\/p>\n\n\n<h2 class=\"wp-block-heading\">6. Rights of the Data Subject<\/h2>\n\n\n<ul class=\"wp-block-list\">\n<li>To know, update and rectify their personal data.<\/li>\n\n\n<li>To request proof of the authorisation granted.<\/li>\n\n\n<li>To be informed, upon request, of the use made of their data.<\/li>\n\n\n<li>To file complaints with the Superintendence of Industry and Commerce.<\/li>\n\n\n<li>To revoke the authorisation and\/or request deletion of the data where applicable.<\/li>\n\n\n<li>To access their personal data subject to Processing free of charge.<\/li>\n\n<\/ul>\n\n\n<h2 class=\"wp-block-heading\">7. Authorisation<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Selva IB will obtain the Data Subject's authorisation on a prior, express and informed basis, by physical or electronic means (web forms, non-pre-ticked acceptance boxes and data messages). It will not be required in the cases provided for in article 10 of Law 1581 of 2012.<\/p>\n\n\n<h2 class=\"wp-block-heading\">8. Procedure for enquiries and complaints<\/h2>\n\n\n<p class=\"wp-block-paragraph\"><strong>Enquiries:<\/strong> will be handled within a maximum of ten (10) business days, extendable by five (5) business days.<\/p>\n\n\n<p class=\"wp-block-paragraph\"><strong>Complaints:<\/strong> will be handled within a maximum of fifteen (15) business days, extendable by eight (8). If the complaint is incomplete, the interested party will be asked to complete it within the following five (5) days.<\/p>\n\n\n<p class=\"wp-block-paragraph\"><strong>Service channel:<\/strong> requests to exercise rights may be sent to contacto@selvaib.com. Selva IB will internally designate the person or area responsible for handling these requests.<\/p>\n\n\n<h2 class=\"wp-block-heading\">9. Security and confidentiality<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Selva IB will adopt reasonable technical, human and administrative measures to protect data against alteration, loss, unauthorised or fraudulent consultation, use or access, and will require the same standards from its Processors.<\/p>\n\n\n<h2 class=\"wp-block-heading\">10. Transfers and transmissions<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Selva IB may transfer or transmit data to third parties, whether national or international, where necessary for the authorised purposes, complying with the applicable legal requirements.<\/p>\n\n\n<h2 class=\"wp-block-heading\">11. National Database Registry (RNBD)<\/h2>\n\n\n<p class=\"wp-block-paragraph\">Where required under the SIC's criteria, Selva IB will register its databases with the National Database Registry.<\/p>\n\n\n<h2 class=\"wp-block-heading\">12. Term<\/h2>\n\n\n<p class=\"wp-block-paragraph\">This Policy is in force from its publication on the website. Databases will be kept for as long as necessary to fulfil the purposes and the applicable legal obligations.
